It doesn't matter either way. Fedex isn't going to knowongly ship you something illegal as that is a risk to their business. They will either work with customs or maybe hand it off to local LE, but they wouldn't just deliver you gear knowingly. In the US any time you get a customs letter you just ignore it. You never claim it because thay is just admitting to a crime. You lost some money, no big deal. Better free than in jail/prison.The reason why I am asking and willing to chance it is because it is FedEx who is asking for it for customs. If this was customs asking me directly or sending a letter I would know to cut my loss.

I would say a friend sent me it as a gift and there is no invoice so they would have to declare it using the paperwork it came with. I've even been asked to provide an email conversation proving it's free or a free sample... That could work if the sender is an individual of course.
If it's a company and they opened it they can bin it just because the invoice doesn't match what's in the box. They have a database they can check where they see the average value of things. If your stuff is way below the average they can get suspicious. If you are going to claim it was a purchase it needs to be realistic.
That's why you only order domestic...
If they haven't confiscated it I think you can still get the goods if you provide them with realistic info. I'm not sure how it works there but I don't think anyone gives a crap about a few freaking GH pens. They have bigger fish to catch.

So what did you do?Canada customs is holding my package asking for an original invoice as they don’t believe the value is $10. I am asking the source to make me an invoice for $120 but could this just be a trap to admit fault or have they actually not opened my package and seized it.

Well now I got an update after a month it says clearance delay “ goods are subject to regulatory review” I guess just now they are opening it so I will be expecting a love letter soon?
