Federal Government Sues Over Arizona Immigration Law

The Justice Department filed a lawsuit on Tuesday against Arizona to challenge a new state law intended to combat illegal immigration, arguing that it would undermine the federal government’s pursuit of terrorists, gang members and other criminal immigrants.

The suit, filed in federal court in Phoenix, had been expected since mid-June, when Obama administration officials first disclosed they would contest the Arizona law, adding to several other suits seeking to have courts strike it down.

The federal government added its weight to the core argument in those suits, which contend that the Arizona law usurps powers to control immigration reserved for federal authorities. The main suit was brought by the American Civil Liberties Union, the Mexican American Legal Defense and Educational Fund and other civil rights groups.

The Justice Department argues the law would divert federal and local law enforcement officers by making them focus on people who may not have committed crimes, and by causing the “detention and harassment of authorized visitors, immigrants and citizens.”

“Arizonans are understandably frustrated with illegal immigration,” Attorney General Eric H. Holder Jr. said. “But diverting federal resources away from dangerous aliens such as terrorism suspects and aliens with criminal records will impact the entire country’s safety.”

The Justice Department suit is also aimed at stemming a tide of similar laws under consideration in other states. “The Constitution and the federal immigration laws do not permit the development of a patchwork of state and local immigration policies throughout the country,” the suit says.

Justice Department officials are “sending an unmistakable cannon shot across the bow of any other state that might be tempted to follow Arizona’s misguided approach,” said Lucas Guttentag, director of the Immigrants’ Rights Project for the A.C.L.U..

The Justice Department asked for a court injunction to prevent the Arizona law from taking effect as scheduled on July 29. Hearings in the other cases are scheduled for July 15 and 22. The law, signed by Gov. Jan Brewer on April 23, makes it a crime to be an illegal immigrant in the state and requires officers to determine the immigration status of people they stop for another offense based on a “reasonable suspicion” that they might be illegal immigrants.

Ms. Brewer assailed the federal lawsuit. “As a direct result of failed and inconsistent federal enforcement, Arizona is under attack from violent Mexican drug and immigrant smuggling cartels,” she said. “Now, Arizona is under attack in federal court from President Obama and his Department of Justice.”

White House officials said Mr. Obama was not involved in the Justice Department’s decision to sue. But the suit came after steps by Mr. Obama in an effort to frame the immigration debate in terms that will favor Democrats in advance of midterm elections in November, including a speech on Thursday when he restated his commitment to overhaul legislation that would give legal status to millions of illegal immigrants.

The suit deepened the controversy over the Arizona law. Representative Darrell Issa, Republican of California, said the president was wasting resources that should be spent controlling the Southwest border.

“For President Obama to stand in the way of a state which has taken action to stand up for its citizens against the daily threat of violence and fear is disgraceful and a betrayal of his Constitutional obligation to protect our citizens,” said Mr. Issa, one of 19 Republicans signing a letter criticizing the suit.

Kris Kobach, a lawyer and consultant to Ms. Brewer who is a co-author of the Arizona statute, said it was tailored to complement federal law. The Justice Department’s suit is “unnecessary,” he said, and “the suspicion is this is more about politics than law.”

In a background call with reporters, a senior department official said the decision to file the lawsuit — and to do so on the ground that it pre-empts federal authority, rather than on civil rights grounds like racial profiling — followed extensive deliberations with the Civil Rights Division and others inside the department, and a trip to Arizona to meet with state officials.

Should the department fail to persuade the courts to block Arizona’s law, the official said, it would closely watch for signs that people of Hispanic appearance were being singled out.

I may sound a little bigoted but , if the federal govt wont stop the criminal's from entering illegally, I say let AZ do what they have to do to protect their citizens...

The Legal Mexicans in this counry should applaud this act... It doesn't take long for a few vagrants to create a negative stereo type for all people who match the profile... They have and will continue to catch a bad rap simply because of the sheer volume of illegal activity crossing the border uncontrollably...

passing the DREAM act would be one of the smartest legislative investments the USA has ever made. Immigration is a Federal issue, and States that jump up to usurp Federal power get the smackdown. :)
 
this just seems to be a repetition of our American history. when the economy is rolling, we cannot get enough foreign labor. When the economy is down, we want them outta here. This has happened multiple times in our history and its happening again. For the record, Ronald Reagan was the last president to declare the last amnesty for immigrants.

For the record, when Reagan was president, we didn't have full on guerilla warfare engulfing our border.

We is an ambiguous pronoun doc. Do you care to specify? I had not even reached gradeschool during the aforementioned period. I am fairly certain that my toddler resume did not include the Iran Contra scandal or Afghan involvement.

Whatever your political views or age when you claim to be an american you represent the good and the bad OUR country has done. I am young, 26, but am still aware of the wrongs Headdoc speaks of and of course had no voice in them. But it doesn't matter. People like to forget the past when talking about what needs to be done in the present. Fueled a war on drugs which is a failure. And one could even argue those drug laws have fueled the illegal immigration we are trying to stop today. AZ's law will be another example of a mistake based on protecting us(Americans) from immigration. It doesn't seem like they thought it through anyway.

Its reactive rather than proactive to a huge problem they can't solve alone. I really doubt this new law will make illegals think twice before coming here. They still have nothing to lose by coming here, being detained and then deported. I don't see how this will protect the citizens of AZ. If they feel like the Fed gov isn't doing enough then they should do something that will make a difference. So, far I have seen no evidence that profiling will keep illegals from coming into the state of AZ, but it will violate the rights of many Americans.Its just bullshit political games.

Bridger, this post was a statement in a conversation that carried over many posts and several threads. I understand full well that the term "American" encompasses both the positive and the negative events and choices of our country. The statement in question was said in sarcasm. Several members constantly rant that America's mistakes are all somehow related to the republican party and conservative belief in general, so being of liberal belief they have no fault for any of today's problems. Just applying the double standard to myself so they can see how foolish it looks on someone else.

Fences, armed guards, air and satellite surveillance.We have a poorly funded program that trys very hard to keep illegal immigrants from coming across our borders. However, once they are here(illegally)...we aren't doing a damn thing to send them back. So if a pipe burst in your house, you would let water cascade unrestricted while you attempt to repair the rupture? No you try to divert the flow for damage control and the set to your repairs. Maybe Arizona is trying to implement damage control in hopes of spurring Federal lawmakers to fix the fucking pipe!!
 
We are doing a disservice to the Mexican people in general by allowing his unfettered breach of the border. We are allowing a brain-drain of sorts. Anyone smart enough to get out, does. Unfortunately, these are also the one's smart enought to fix the political system. If the Mexicans were made to stay in Mexico, maybe there would be a stronger drive to fix the colossal screw-up that is Mexican internal politics. Instead, the (mostly) good people that could affect a change in the Mexican system, either by voting or revolution, come here. We can all agree that Mexico is a F**ked-up place politically and socially. That will not change, and the flood across the border will not slow, until the Mexican people get fed the hell up with the situation and take their country back.
The drug cartels in Mexico represent a very dangerous and very real insurgency. We should train and arm the Mexicans to go home and bitch-slap the drug lords.
Our federal government's first duty is to the people of this country. Not to make sure that anybody that comes here feels all warm and fuzzy. That load of shit on the bottom of the Statue of Liberty: "Give me your tired, your poor,Your huddled masses yearning to breathe free,The wretched refuse of your teeming shore.Send these, the homeless, tempest-tost to me,I lift my lamp beside the golden door!" is just that: BS. That's a fucking poem on a statue, not the Constitution!
"We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America." Where does it say that we are supposed to make sure that everybody that wants to is welcomed to come and compete with our citizens for jobs and the other blessings of liberty as granted by our constitutional rights?
We don't have to be cold, heartless bastards, but there is a reason that there is a set legal immigration policy that restricts the numbers of peoples from other countries by quota. The Mexicans (I refer to Mexican Nationals) need to fix Mexico, and stay the fuck out of the US!

White Americans won't serve tables, pick fruit, or do a hundred other nasty jobs for less than $20/hr it seems, but illegals will. Walmart BTW dictates prices to its suppliers (inverted dist-supp relationship) and thus plays critical role in curbing price creep.

Sure, ship all the Mexicans out of the USA and watch your standard of living drop by way of prolonged inflation and increased unemployment. Say goodbye to cheap car washes, cheap food at the grocer, ETC, ETC, ETC.

Wrong time for this...I'd gladly trade a little crime for enhanced economic security in such a perilous time; sorry Arizona, but the Hispanics will punish you with their ballots and no other state will touch this political H-bomb.

Where people get that Mexican labor is cheap labor is beyond me. Chinese labor = cheap, Indian labor = cheap, Portugese, Nepalese, Phillipine the list goes on. Mexican labor is not cheap, it is easily available and easily replaceable., that is its allure. There are no sweat shops in the US filled with Illegal mexicans. The sweatshops that WALMART uses to secure its low prices are all over-seas, not our problem. Poor poor mexicans, they are our economic backbone......horseshit! They are viable competitors fighting for a piece of an ever-shrinking pie. And worse, illegals make NO contribution to state and national revenue as they pay no taxes, social security, medicare etc. AAAAAAGGHHHHHH!

What people don't understand is that not only do they "not contribute" to our economy, they take money away from our economy!!! I used to bartend at a mexican restaurant that had several cooks that I was sure weren't legal. They would tell me that they would send at least half of EVERY paycheck back to their families in Mexico. Who knows how many US dollars have been drained out of California and back into Mexico!

For those of you that live in the Northeast or wherever te mexican population isn't high, WAKE UP! Vote this motherfucker out of office if you want to keep it that way! Mexicans are fine people...until they decide to live in the US without paying taxes and fucking up our economy. The problem is that other than border states, not many states experience the actual impact of what is going on. In California, there are entire cities that are knows as "sanctuary" cities that are composed almost entirely of illegals. Corrupt police depts that make it "illegal" to ticket aliens for driving without a driver's license. If you don't believe me, check out the city of Maywood, CA. Just google it. This is right in my backyard. This shit has to stop! NOW!
