Civil rights attorney says Hispanic officers may have targeted 'white boy' because they 'don't like him living in their community'

Police forced New Mexico scrap metal tradesman David Eckert to undergo two digital anal probes, three enema insertions and ultimately a colonoscopy after officers incorrectly assumed he was concealing drugs, according to a lawsuit filed in U.S. District Court on his behalf.

No drugs were found by police or doctors at the Gila Regional Medical Center in Silver City, N.M. The exhaustive search began when Eckert allegedly rolled through a stop sign in Deming, N.M., on Jan. 2, 2013.

Albuquerque civil rights attorney Shannon Kennedy is representing Eckert and says she is seeking "in excess of $1 million in punitive damages alone" from the law enforcement and medical personnel responsible and their employers.

Yesterday, we discussed the horrific allegations against police from Deming, New Mexico and the medial staff of Gila Regional Medical Center in Silver City, N.M. They (and others including the local prosecutor) allegedly conducted repeated digital anal searches of man stopped for a minor traffic violation and then performed multiple enemas and a colonoscopy in search of drugs. David Eckert has sued for both compensatory and punitive damages. However, I learned today that in addition to the alleged physical abuse, he was sent a $6000 bill from the hospital for the involuntary colonoscopy.

His lawyer says that the hospital sent him the bill, which is perfectly bizarre. They must be treating this as if he had come into the hospital unconscious and required the procedure. Yet, he was objecting to the procedures and the other intrusive measures taken against him. Hopefully, the court will rule against the likely motion al limine filed by the hospital to keep the bill out of the trial. I would love to see the jury that is informed at the end of this alleged nightmare, Eckert received a bill for his mistreatment. As opposing counsel, it is sometimes better to be the one to mention such damaging facts in your opening argument to avoid Plaintiff’s counsel dropping it with greater effect at trial.

What is clear is that, regardless of the outcome at trial, someone needs to be fired for such absurd acts. My assumption is that the police declined the bill for the procedure but it is not clear who made this decision.

A second man is alleging that Hidalgo County, N.M., police violated his rights and escalated a minor traffic stop into an anal-probing nightmare as they searched in vain for drugs.

Timothy Young was stopped on Oct. 13, 2012, for allegedly turning without a signal, KOB-TV first reported Tuesday evening. A K-9 dog erroneously indicated he had drugs in his vehicle and he was taken to the Gila Regional Medical Center in Silver City, N.M., where doctors performed an x-ray scan and a digital anal probe.

Kennedy is also representing David Eckert, who was stopped on Jan. 2, 2013, by Deming, N.M., police for allegedly rolling through a stop sign. Eckert was also taken to the Gila Regional Medical Center – where he was x-rayed, forcibly given enemas and then given a colonoscopy.

Three Deming policemen and three Hidalgo County officers were allegedly involved in the Eckert case, which may be settled out of court. Named defendants include the six policemen, the medical center, two doctors and a deputy district attorney who secured a warrant authorizing an anal probe.

No drugs were found in the possession of either man.

KOB-TV reports that a K-9 dog named "Leo" incorrectly alerted police to the existence of drugs in each of the men's vehicles. The station reports that Leo's drug-sniffing certification expired in April 2011.

On January 2, 2013, Eckert had finished shopping at Walmart when he did not stop at a stop sign after leaving the parking lot. I recently wrote about police have used such pretext stops for searches after the Supreme Court refused to consider the motivations of police in such encounters. In this case, Eckert was told to step out of his vehicle for the minor failure to stop. An officer said that he thought Eckert appeared to be clenching his buttocks. This was used as the basis for probable cause that he had drug in his anal cavity and he was taken to a hospital in Deming for an anal exam. The doctor however refused on ethical grounds.

That did not stop the police however. They went to Gila Regional Medical Center in Silver City where doctors appear to have few ethical qualms. They reportedly x-rayed him but found no evidence of drugs. Rather than admit mistake, the doctors were then told to go forward and they explored Exkert’s anus using their fingers. No drugs were found. However, rather than admit their error, they went forward with a second penetration of the anus. No drugs were found. Rather than admit error, they then ordered a third penetration with an enema. He was then forced to defecate in front of witnesses. No drugs were found. They then penetrated his anus with a second enema. He was again forced to defecate in front of witnesses and his stool again inspected. No drugs were found. He was then penetrated a fifth time with a third enema and he was again forced to defecate in front of witnesses. No drugs were found. No willing to admit mistake, he was then sedated and doctors performed a colonoscopy where a scope with a camera was inserted into his anus, rectum, colon, and large intestines. No drugs were found. So to wrap of the account below: we have five manual penetrations; three forced defecations before witnesses; and an intrusive surgery under sedation. All of this was done without consent and without any basis other than an officer saying he looked like he was clenching his buttocks.

The alleged abuse follows the concept of “path dependence” in economics where people will not consider alternatives due to the investments in an original course or concept. When no drugs were found, it seemed to commit the police and doctors to more examinations to justify their actions.

Deming Police Chief Brandon Gigante is qouted as saying “We follow the law in every aspect and we follow policies and protocols that we have in place.” Obviously, those policies and protocols need to be examined.

David Eckert is suing The City of Deming; Deming Police Officers Bobby Orosco, Robert Chavez and Officer Hernandez; Hidalgo County Hidalgo County Deputies David Arredondo, Robert Rodriguez and Patrick Green; Deputy District Attorney Daniel Dougherty;the Gila Regional Medical Center; and doctors Robert Wilcox, M.D and Okay Odocha, M.D.

What is most disturbing is that the police secured a warrant from a judge with the presumed help of the district attorney. So if a person stopped on the most minor traffic stop appears to be clenching, that is considered sufficient for a warrant ordering an anal cavity search.

What the hell was he doing all this time? They would have had to beat me unconscious, then keep me that way with drugs, and I sure as hell would have tried to kill some motherfucker when I woke up. the warrant was only valid in Luna County, where Deming is located. The Gila Regional Medical Center is in Grant County. That means all of the medical procedures were performed illegally and the doctors who performed the procedures did so with no legal basis and no consent from the patient.

In addition, even if the search warrant was executed in the correct New Mexico county, the warrant expired at 10 p.m. Medical records show the prepping for the colonoscopy started at 1 a.m. the following day, three hours after the warrant expired.

"This is like something out of a science fiction film, anal probing by government officials and public employees," Kennedy said.

Unfortunate for the gentleman that had to go through this... As his civil rights were violated...

Not that it matters for him or makes it right... But, he will never have to work again. After his lawyers get done with malpractice suits on the doctors... Then lawsuits against the hospital... Finally, the cities and townships that employed the officers.

There is along line of suits that will take place for the next several years.

Be interesting to see how this finalizes.

Not to throw conspiracies theories out there.... Be prepared for more of this as we approach a police state and martial law.

DHS has the power to do as they wish.

The Cops would have arrested me for an Assault charge, before they even got my Pants off, and the Doctors would have caught a bad break, when I took that Endoscope and beat him over his head and them rammed it down his throat. I hope that guy gets like 10 million for pain and suffering alone.................JP

Aren't these the same cops that shot a woman to death for a Moving Violation, this year, I think yes.

I can tell you this. If that happened to me there would be consequences. It may not be tomorrow. It may not be next month. In fact I'm sure it would be years from now. But many of those people were find they were in the middle of a BAD "accident" years or even decades from now. Revenge is best served ice cold.

Just another prime example of how out of control the police force is. My favorite part the civil service commission will defend them for free while they get paid leave of absence. Undoubtedly they won't even lose their jobs.

I just got back from a predominately Mexican city and this story doesn't surprise me a bit. Never in my life have I been around more rude and dirty people!!! I'm sure there are some decent ones somewhere out there, but from what I was around in the week I was in this shithole......fuck em!!!!
