Soares eventually should (would?) be brought up on ethics charges as he is violating a Federal law (HIPPA) by releasing names of patients (whether real or not is irrespective) of doctors and pharmacies to the public. This is analogous to your local Walgreen or CVS releasing the names of its clients and what medications they take as well as someone breaking the doctor-patient relationship - HIPAA is privacy laws and someone should bring Soares up on it or better yet someone named publickly should threaten to sue him and have his/her lawyer file ethics charges with the NY State Law Bar.

Soares may be in violation of a Federal law here (HIPAA - the medical privacy act) and potentially should/could be brought up on Ethics charges (much like that of the Duke-rape case attorney).

Privavcy in medicine extends to what and whom sees a doctor as well as what medications he or she is on. The analogy here is that if this was Walgreens or CVS that the names of patients and what medications they were prescribed was given to the press from the AG/DA office, than it would be an obvious violation of HIPAA and more people would be in an upropar about privacy being violated - would you like the whole town or country to know what meds your doc prescribed you? Any lawyers familiar with HIPPA out there? Anyone want to file an Ethics compliant or get one of the named people to sue for violation of privacy?

Thoughts?
