Bruce Kneller of Canton, known in the bodybuilding world as the “Steroid Guru,” was arrested in 2006 for selling steroids online. He pleaded guilty to drug and gun charges and was sentenced to 45 days in jail.

The court ruling says Kneller had $124,800 worth of illegal steroids in his Blue Hills Village condo in Canton when it was searched.

State Police seized his 2004 Audi and froze a Bank of America account containing more than $200,000.

Authorities are allowed to seize property used in criminal acts. Tuesday’s ruling says the right of seizure also applies to items not directly used in the committing of crimes.

2009: COMMONWEALTH v. ONE 2004 AUDI SEDAN AUTOMOBILE & others.

Four thousand three hundred fifty dollars in United States currency and $226,511.92 in a Bank of America account; Bruce Kneller, intervener.

Background: Commonwealth filed a civil complaint for forfeiture of funds related to criminal activity. Owner of funds filed motion to dismiss. The Superior Court Department, Norfolk County, Kenneth J. Fishman, J., granted motion. Commonwealth petitioned single justice for leave to file interlocutory appeal. Application was granted, and proceedings below stayed, by Lenk, J., and Commonwealth appealed.

Holdings: The Appeals Court, Smith, J., held that:

(1) as matter of first impression, Commonwealth was not required to demonstrate existence of probable cause in the complaint;

(2) as matter of first impression, Commonwealth was required to include in complaint enough information to give defendant notice of what dispute was about and assert right to recovery cognizable on some acceptable legal theory; and

(3) Commonwealth pleaded sufficient facts to state cause of action for claim of forfeiture.

Vacated and remanded.

Fishman, J., allowed claimant's motion to dismiss. Commonwealth petitioned single justice Appeals Court for interlocutory appeal. Single justice for the Appeals Court, Barbara A. Lenk, J., allowed petition and stayed proceedings in the Superior Court. The Appeals Court, 73 Mass.App.Ct. 311, 897 N.E.2d 1030, vacated allowance of motion to dismiss and remanded to the Superior Court. Claimant appealed.

Holdings: The Supreme Judicial Court, Gants, J., held that:

(1) as matter of first impression, on motion to dismiss, trial court was required to determine whether allegations in complaint supported reasonable belief that, at trial, Commonwealth had probable cause to believe that funds were related to claimant's steroid distribution operation, and

(2) allegations in complaint, which incorporated special agent's affidavit, were sufficient to establish reasonable belief that Commonwealth would, at trial, establish probable cause to show that frozen funds were related to steroid distribution.

Judgment of the Superior Court vacated; remanded.

the whole thing is disgusting, n makes the Tea Party thing understandable, tho still laughable. i'm sure this scale of asset/property seizure will be used on smaller n smaller 'offenses' if it's not stopped by an active lobby.

I don't know ANYONE who called fat boy Bruce the "Steroid Guru." That was the name given to Dan Duchaine and Dan couldn't stand Bruce. I'm dumbfounded that people still listen to anything that Kneller has to say after all these years. He's just a morbidly obese guy who wanted to be a bodybuilder, but couldn't push himself away from the table or dedicate himself to training.
